Shipping policy

1. Scope

This Shipping Policy applies to all orders placed through our website or by other means with GMS (herein “Vendor,” “we,” “us”). By placing an order you (the “Buyer”) agree to be bound by this Shipping Policy together with our Terms & Conditions and any other applicable policies. This Shipping Policy is governed by the laws of the State of Georgia, and the parties submit to the exclusive jurisdiction of the courts of Georgia.

2. Order Processing and Shipment

  • We will process orders within 1–5 business days” after receipt of payment and order confirmation.

  • Shipping times are estimates only. We do not guarantee delivery dates unless a specific delivery date is agreed in writing. In Georgia, under O.C.G.A. § 11‑2‑504, when the Vendor is required or authorized to ship goods via carrier and no specific destination delivery term is required, the seller’s obligations are to: (a) place goods with a carrier, (b) obtain and deliver necessary documents, and (c) promptly notify the buyer of shipment.   • If we are unable to fulfill shipment within the estimated time, we will promptly notify you and may offer a revised shipping date. If you decline the revised date, you may cancel your order for a full refund of any payment made.

3. Shipping Methods and Charges

  • Shipping charges will be as displayed at checkout (or as invoiced) and may vary depending on destination, weight/size of goods, carrier, customs or duty charges (if applicable), packaging, and handling.

  • Unless otherwise specified, shipping charges are non-refundable once the goods have been dispatched.

  • Responsibility for customs, import duties, taxes, or other charges arising in the destination country (for international shipments) lies with the Buyer.

4. Risk of Loss; Title

  • Title to the goods remains with Vendor until payment is received in full and the goods are delivered and accepted by the Buyer.

  • Unless otherwise agreed in writing, risk of loss or damage to the goods passes to the Buyer at the earliest of the following under Georgia law: (i) the goods are duly delivered to a carrier when the contract allows or authorizes shipping by carrier and does not require delivery to a particular destination; or (ii) when the goods are tendered for delivery at the destination, if a destination delivery term is required.   • For clarity: If goods are shipped via carrier and the contract does not require delivery to a particular destination, the buyer bears risk of loss once we hand the goods over to the carrier. 5. Shipping Damage, Loss & Claims

  • You must inspect the goods upon receipt. If you believe the shipment has been lost, damaged in transit, or delivered in error, you must notify us within 5 business days of receipt (or expected receipt) with your order number, description of damage or loss, and photographic evidence if applicable.

  • Unless we expressly agree otherwise in writing, once the risk of loss has passed to you as described above, we are not liable for damage, loss, or theft subsequent to that point.

  • We recommend that you retain all packaging and shipping materials until any claim with the carrier (and us) is resolved.

  • If we agree to accept a return for a damaged item, return shipping costs will be addressed as follows: [insert your return shipping cost policy].

6. Delivery Issues; “Undelivered Merchandise”

  • In Georgia, the sale of goods rules require that when a timeframe is promised, a merchant must ship within that timeframe or provide notice of delay and an option to cancel. Georgia Consumer Protection

  • If we advertise a shipping time or promise delivery by a certain date, and we fail to ship by that date, you have the right to cancel the order and receive a full refund for payments made.

  • However, unless explicitly promised in writing, estimated shipping/delivery times are non-binding.

  • If you fail to accept delivery or the carrier returns goods to us due to Buyer’s fault, shipping/handling costs and any restocking charges may be charged to you.

7. Returns & Exchange Shipping

  • Unless otherwise stated in our Returns Policy, shipping and handling charges paid by Buyer are non-refundable if the Buyer cancels after dispatch.

  • For returns or exchanges, the Buyer is responsible for shipping costs unless the return results from our error (wrong item shipped, defective item, etc.).

  • We may charge a restocking fee of 15% of the item’s invoice price if return is for Buyer’s convenience and goods are returned in resalable condition.

8. Force Majeure; Delays Beyond Our Control

  • We shall not be liable for any delay or failure to ship due to causes beyond our reasonable control, including but not limited to Acts of God, natural disasters, war, strikes, carrier delays, customs clearance, pandemics, government actions, shortage of raw materials, or other supply‐chain disruptions.

  • In such cases, we will notify you of the delay and will use commercially reasonable efforts to resume performance as soon as practicable.

9. Taxes, Customs & Import Duties

  • For shipments inside Georgia or to other U.S. states, we will collect any required sales tax in accordance with Georgia regulations (see Ga. Comp. R. & Regs. Rule 560‑12‑2‑.45 regarding delivery charges and taxability). Legal Information Institute

  • For international shipments, you (the Buyer) are responsible for any customs duties, import taxes, or other assessments in the destination country.

10. Governing Law & Venue

  • This Shipping Policy and all transactions are governed by the laws of the State of Georgia.

  • Any dispute arising out of or relating to this Shipping Policy shall be brought solely in the state or federal courts located in [insert county, Georgia], and the parties submit to exclusive jurisdiction and venue in those courts.

11. Amendments

  • We reserve the right to amend this Shipping Policy at any time. Your continued placing of orders after the date of any amendment constitutes your acceptance of the updated policy.
