By using or purchasing from the GLOW Mintsmiles website, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using our site or products sold on our site.

Usage: Follow all directions provided on packaging or our website.

Results: Individual whitening results may vary based on enamel condition, diet, and consistency of use.

If you have cavities, gum disease, braces, dental restorations, or sensitive teeth or are pregnant or under medical supervision consult a dentist before use.

By purchasing or using Glow Mintsmiles products, you acknowledge and accept all associated risks and agree that Glow Mintsmiles, LLC is not liable for misuse or adverse reactions.

SECTION 3 – ORDERS AND ACCEPTANCE

By placing an order, you are making an offer to purchase subject to these Terms.

GMS reserves the right, at its sole discretion, to:

Accept or decline any order;
Cancel or limit quantities; or
Refuse service to any customer.

An order is not accepted until payment is successfully processed and you receive an order confirmation. If an order cannot be processed or must be modified, we will attempt to contact you via the information provided.

All purchases are final and subject to our Refund Policy.

GMS operates the Store; Shopify merely provides the e-commerce platform.

All transactions occur directly between you and GMS. Shopify is not responsible for any aspect of your purchase, and you expressly release Shopify and its affiliates from all claims related to your transactions with GMS.

SECTION 9 – FEEDBACK AND USER CONTENT

By submitting any Feedback, you grant GMS a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, publish, modify, and display it for any purpose.

You represent that you have all necessary rights to grant such a license and that your Feedback complies with applicable laws and these Terms.

We may remove any Feedback at our sole discretion and are not obligated to compensate or respond to submissions.

GMS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

SECTION 14 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, GMS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR USE) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless GMS, Shopify, and their affiliates, employees, and agents from any and all claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your:

Violation of any law or third-party right; or
Misuse of the Services or Products.

SECTION 16 – DISPUTE RESOLUTION; ARBITRATION AND CLASS ACTION WAIVER

To the maximum extent permitted by law, any dispute or claim arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration on an individual basis and not in a class, representative, or consolidated action.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Venue shall be in Atlanta, Georgia, unless otherwise required by law.
Each party shall bear its own costs and attorney’s fees, except where recovery is authorized by statute.

You waive any right to a jury trial or to participate in a class action.

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

SECTION 18 – ENTIRE AGREEMENT AND WAIVER

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to conflict of law principles. You consent to the exclusive jurisdiction and venue of the courts located in Fulton County, Georgia.

We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of the Services after such updates constitutes your acceptance.
